2nd Parent Adoptions
There are a number of situations in which a parent wishes to consent to adoption of a child by another person who is not a biological mother or father of the child, but will assume legal parental rights along with the biological parent. Our Nevada family law firm often receives requests for information and assistance planning for and carrying out second-parent adoptions, including the following:
- Step-parent adoptions, when the other biological parent agrees or is not involved in the child’s life.
- Additional family member adopting as second parent: grandparent, sibling or cousin, for example.
- Domestic partner who may be in a same-sex or heterosexual relationship with the custodial biological parent.
If your family has experienced loss — such as death of a parent, long-term imprisonment of the father, or abandonment by the mother — you have no doubt done your best to give your child a stable, loving home. Another person who adopts the minor child takes the role of a second parent in a legal sense. Through adoption, a child acquires all the rights of a natural child of the adoptive parent.
A Home Study May Not Be Required
Are you worried about the costs and stress of a home study before adoption of your child by a second person? Allow our lawyers to explain circumstances in which a home study may not be necessary. If the second-parent-to-be (step-father, step-mother, grandfather, grandmother, brother, sister, cousin or domestic partner) has a strong relationship with the child, you may not have to submit to a pre-adoption home study.
Helping families become stronger is rewarding to our Nevada family law attorneys. We welcome the opportunity to answer your questions and explain how we can assist with a second-parent adoption.
